Tithe with Bitcoin Terms of Service

  

Tithe with Bitcoin, Inc. (“TwB”) provides this website & service subject to these Terms of Service. By using our service, members are agreeing to the Terms of Service. These Terms of Service are subject to revision and update without notice. Most current Terms of Service will be published on our website and are available for download. Please refer to www.tithewithbitcoin.com for the most current Terms of Service. Continued use of the website and participation in our network will serve as agreement to amended Terms of Service.


1. Your Membership

Tithe with Bitcoin, Inc provides an online platform (www.TithewithBitcoin.com) to enable Members of our Network (“Members”) to accept Bitcoin as a form of donation, as well as empowering those who possess Bitcoin to donate to those Members. Nonprofit, Religious, Spiritual and Charitable Organizations are eligible to become Members of the TwB Network. 

To become a Member, please provide your organization’s name, physical address, the name of an authorized representative within the organization and a valid email address.

Once TwB has updated our system to include a new Member organization, you authorize TwB to use your organization’s name, logo and other identifying information on our website and other marketing material. 

A Bitcoin wallet and address will be assigned to and maintained on behalf of the Member. As incoming Bitcoin (“BTC”) donations are received, TwB will process and convert the cryptocurrency balance into U.S. Dollars (“USD”). Network fees will be deducted from the incoming donations, and net funds will be dispersed to members of our network.

Membership within the Tithe with Bitcoin network is considered at-will. Tithe with Bitcoin reserves the right to terminate membership to any organization within our network at any time, without warning or justification.

Members of our network can request a copy of their annual donation statement from Tithe with Bitcoin at any time by sending a written request to: info@tithewithbitcoin.com.


2. Bitcoin Wallets

Bitcoin wallet activity can be viewed in real-time by visiting www.blockchain.info. Enter the wallet address in the search bar, and the incoming donation summary will be listed under “Total Received”. Set the transaction filter to “Received” to view a summarized list of all incoming donations. 


3. Fee Structure

Tithe with Bitcoin charges a maintenance fee to support our operations, which is typically derived from incoming donations at a fixed rate (3.0%).  However, special assessments may be necessary to cover certain unforeseen expenses, in which case the incoming donation maintenance fee will be set to an adjusted rate for a limited duration.


4. Payments to Member Organizations

The Network Fees derived from a Donor’s donation will be deducted from the designated Member’s Bitcoin wallet at the time of processing. Incoming donations will be processed and converted from BTC to USD within 24 hours of the network confirmation.  BTC to USD conversion rates are based on spot Bitcoin price as displayed on Coinbase.com at the time of conversion. TwB will disperse funds through our weekly distribution schedule. Funds will be distributed to members of our network either as a check through U.S. Mail (USPS) or through electronic transfer (Venmo, Cash App, etc.). Additional fees may apply for electronic payments.

Member Organizations will be responsible for any taxes based on its net income or gross receipts.


5. Donor Responsibilities

If you are a Donor, you are solely responsible for ensuring that you have selected the correct organization and Bitcoin address to donate to.  All donations to Members are made as unrestricted gifts and may not be specified for any particular purpose. The amount of donations to the Member designated by you are sent to the registered Bitcoin wallet, confirmed by the Bitcoin network, and processed by TwB on such Member’s behalf. All payments of donations are final and non-refundable. You will send the online donations to the Member designated by you, or to a General fund or Development Team fund. The donation will be settled into the Member’s designated bank account as the applicable bank and processing partners make them available, or a physical check will be issued to said Member. Your donations to the Member organization designated by you will be net of any fees associated with your transaction (“Network Fees”), as set forth on the TwB fee structure. This fee structure is subject to change from time to time at the sole discretion of TwB.  Donors agree not to use an invalid or unauthorized BTC wallet / account in making transactions on TithewithBitcoin.com.  Once a donation is made, the transaction is final and not subject to dispute. 

TwB will make a Donation Receipt available for donors who wish to have a record of donations made through our system. Donation receipts are available for download from our website: www.tithewithbitcoin.com 

While TwB focuses on donations to Religious, Spiritual and Charitable Organizations, each Member of our Network may or may not be a registered 501(c)(3) nonprofit. Donors must independently verify with the Member organization about current 501(c)(3) nonprofit status. Tithe with Bitcoin, Inc. is not a registered nonprofit. 


6. Refunds

Due to the irreversible nature of Bitcoin transactions, all transactions are final and not subject to dispute.  Use caution to ensure the correct address is used as intended, as refunds are not available as a result of erroneous or unintended transactions.

If you become aware of fraudulent use of your account, you must notify your TwB immediately. The Member Organization may, at the Member’s sole discretion, refund all or part of a donation to the Donor.


7. Limited License

TwB grants Member Organizations and Donors a non-exclusive license to use TwB’s donation platform and website (collectively, “Our Service”).  This Agreement will also govern any upgrades provided by TwB that replace and/or improve the original platform, unless such upgrades are accompanied by a separate license, in which case the terms of that license will govern.

Except as and only to the extent expressly permitted in this License or by applicable law, you may not copy, decompile, reverse engineer, disassemble, modify, duplicate or create derivative works of Our Service or any part thereof.


8. Copyright

Except where indicated, all Information and Software available through TithewithBitcoin.com is the exclusive property of TwB or its licensors and is protected by copyright and intellectual property laws. All copyrightable text and graphics, the selection, arrangement, and presentation of all materials and the overall design of this web site are Copyright 2018.  All rights reserved.

You may not reproduce, retransmit, disseminate, sell, publish, broadcast, nor shall any Content be used in connection with creating or promoting any online donation service or product, or any other commercial service, without the express written consent of TwB or its licensors. You may not copy, modify, or reverse-engineer the HTML code used to generate web pages on the site. You may not use the Website or Our Service on, or in connection with, any other website, for any purpose, without written consent from TwB.  You are entitled to use the Website and Tools for your private, non-commercial use only.


9. Trademarks

Tithe with Bitcoin, TithewithBitcoin.com and the Tithe with Bitcoin logo are registered trademarks of Tithe with Bitcoin, Inc.  All other TwB services and proprietary tools, are trademarks of Tithe with Bitcoin, Inc.   All other brands and names are the property of their respective owners.


10. Assignment

It is possible that as Tithe with Bitcoin, Inc. continues to develop our products, TwB’s services and/or related assets might be acquired as part of a merger or acquisition.  In such an event, you understand and agree that Tithe with Bitcoin, Inc. may assign its rights under these Terms of Service and that your personal information may be transferred to the succeeding entity. You will be provided with reasonable notice and an opportunity to opt-out of the transfer.


11. Limitation of Liability

YOUR USE OF THE WEBSITE AND OUR SERVICE IS ENTIRELY AT YOUR SOLE RISK. NEITHER TITHE WITH BITCOIN NOR ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR ANY THIRD-PARTY INFORMATION PROVIDERS AND VENDORS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, INCOME, FUNDS, CRYPTOCURRENCIES, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, OR DAMAGES CAUSED BY THEFT, LOSS, UNAUTHORIZED ACCESS, SYSTEMS FAILURE, OR COMMUNICATIONS LINE FAILURE, OR THE COST OF PROCURING SUBSTITUTE GOODS OR SERVICES, CAUSED BY THE USE OF OR INABILITY TO USE THE WEBSITE, MATERIALS OR ANY PRODUCTS OR SERVICES PROVIDED HEREIN, OR ANY OTHER MATTER RELATING TO THIS WEBSITE, EVEN IF TITHE WITH BITCOIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. TO THE EXTENT THAT A JURISDICTION DOES NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY AS SET FORTH HEREIN, THE LIABILITY OF TITHE WITH BITCOIN AND ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND ANY THIRD-PARTY INFORMATION PROVIDERS AND VENDORS IS LIMITED TO THE EXTENT PERMITTED BY LAW IN SUCH JURISDICTIONS.


12. Indemnification

You shall indemnify and hold harmless, and at Tithe with Bitcoin’s request, defend Tithe with Bitcoin and its affiliates, as well as the respective directors, officers, shareholders, employees, agents and owners (each, an “Indemnified Party”) from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys’ fees, an allocation for in-house counsel, and other legal costs) arising out of your acts or omissions, including claims resulting from your use of the Website, Our Service, or any breach of your obligations set forth in this Agreement. You shall reimburse each Indemnified Party on demand for any costs, expenses and liabilities incurred by such Indemnified Party to which this indemnity relates.

Tithe with Bitcoin strives to provide a trustworthy and robust system to process and manage cryptocurrencies, and will take every measure to ensure funds are secure. However, Tithe with Bitcoin will not be held responsible for lost, stolen or misappropriated funds or cryptocurrencies.
